Orders

Placing an order:

The technical steps required creating the contract between you and us are as follows:

You place the order for your products on the Website by pressing the place order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website.

We will send to you an order acknowledgment email detailing the products you have ordered. This is not an order confirmation or order acceptance from Akshar Creative.

As your product is shipped from our warehouse we will send you a dispatch confirmation email.

Order Acceptance:

Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products or services from us. Our acceptance of your order will take place only when we dispatch the product(s) or commencement of the services that you ordered from us.

We will notify you by email as soon as possible to acknowledge that we have received and are processing your order. The duration of our contract with you will start from when you order and we take payment and dispatch the products, until the your right to cancel before the approval.

Order Non-acceptance:

Non- Acceptance of an order may be a result of one of the following:

  • The product you ordered being unavailable from stock.
  • Our inability to obtain authorization for your payment.
  • The identification of a pricing or product description error.
  • You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

Akshar Creative attempts to be as accurate as possible with regards to the products and services offered on Akshar Creative. However, Akshar Creative does not warrant that product descriptions or service descriptions and other contents on this website are accurate, complete, reliable, current and error-free. The photographs, videos or audio clips or some other graphics of a product/service along with specifications and overviews are indicative in nature and often are not the same products or services we offer on Akshar Creative, due to emissions or errors. As a user, you make a complete and independent assessment before purchasing a product or service from Akshar Creative. For any additional help, you may visit our other sections of the self-help website with your questions and seek help from our contact center. If a product/service offered by Akshar Creative is not as described, your sole remedy is to it in the unused condition without any additional claims. Orders will only be accepted if there are no material errors in the description of the goods or services or their prices as advertised on this website.

The prices offered on Akshar Creative are final and binding except when Akshar Creative admits that there were errors in publishing the prices on the website prior to shipment. Except where noted otherwise, the Standard Price displayed for products or services on our website represents the full retail price listed on the product/service itself, suggested by the manufacturer or supplier/service provider or estimated in accordance with the standard industry practice or the estimated retail value for a comparably featured item offered elsewhere. The Standard Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain items/services that are offered as a set, the Standard Price may represent “Bundle Price”, which means the aggregate of the manufacturer/supplier/service provider’s estimated or suggested retail price for each of the items/services included in the set.

With respect to the products/services sold by Akshar Creative, we cannot confirm the price of an item/service until you order; however, we do NOT charge your credit card until after your order has entered the shipping process. Despite our best efforts, a small number of the items or services in our catalog may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

All orders are subject to the acceptance by the courier for delivery to the shipping address chosen by you at the time of ordering

All prices displayed on Akshar Creative will be in Indian Rupees when the website is accessed from India. The prices in US Dollars may be displayed when the website is accessed from outside India. Akshar Creative does not accept orders in any other currency except in Indian Rupees if ordered in India. Akshar Creative does not accept orders in any other currency except in US Dollars if the order is placed outside India. Akshar Creative identifies the geographies through Internet Protocol (IP) address. Irrespective of the ordering destination as detected by IP Address, the end deliveries will always happen only in India unless or otherwise notified to you in writing.

Whilst we try to display the colors of our products accurately on the website, the actual colors you see will depend on your computer monitor or on your portable devices such as a mobile phone or a Tablet PC and we cannot guarantee that your monitor’s display of any color will accurately reflect the color of the product on delivery.

All items are subject to availability. We will inform you as soon as possible if the product(s) or service(s) you have ordered are not available and we may offer the alternative product(s) or service(s) of equal or higher quality and value.

Akshar Creative offers “Goodwill” exchange which may be exercised by the Buyer or the Recipient of the Gift. By placing an order on Akshar Creative, the Buyer agrees that the Recipient may opt for replacement in accordance with the Replacement policy.

GIFT MESSAGES

If you order a product or service as a gift for your family, a friend or a relative, Akshar Creative may offer you the opportunity to add a gift message to your purchase. If you choose to use the gift message service, you acknowledge and agree that:

  • The gift message service is provided for your own personal and non-commercial use only
  • The gift message you instruct us to send on your behalf to a third party will not contain anything which could be construed as harassing, threatening, vulgar, abusive, obscene, defamatory, racist or which may cause embarrassment or distress to any person or which is otherwise unlawful or objectionable
  • You will not impersonate any person, including but not limited to any of our employees or customers
  • You are entirely responsible for the text and other content of your gift message and Akshar Creative accepts no responsibility or liability for any such content or outcome as a result of your message
  • We do not pre-screen or edit messages, but may monitor content from time to time for the purpose of guarding against unlawful or inappropriate gift message
  • We have the right to refuse to send messages and to terminate access to the gift message service at any time and without liability to you

Payment Terms

During the checkout process, you will be asked to enter your payment details. By completing your payment details you confirm that the credit or debit card being used is yours. All fields indicated as compulsory must be completed. Please note that we may collect and store your information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy and Cookie Policy.

Akshar Creative will accept the following payment terms for all orders placed online by the customers:

Credit card/Debit card/Net Banking:

Master/Visa Credit cards and Debit cards, Net Banking from most of the banks in India. You need to have your own Credit Card or Debit Card with relevant information such as Credit Card billing address, Credit Card/Debit Card Number, name written on the Credit/Debit card, expiry date, billing address with Pin code (Zip code) and Verified by Visa/ Mastercard SecureCode password to complete the authenticated payments through our payment gateway which is safe and secure.

We do not store your card information except the last four digits of your credit/debit card for security purposes.

If you prefer to make the payment through Net Banking, you need to have your bank account login and password and transaction passwords to complete the transaction. Akshar Creative does not allow you to use third party credit/debit cards or personal bank accounts even if they authorize you. We don’t accept American Express and PayPal payments as of now.

In case of a High-Value Order, we may ask you to produce additional documents such as an ID Proof (Voter ID Card, PAN Card or Passport) and a front copy of the Credit/Debit Card displaying your name and a credit card statement with your billing address.

All products ordered will remain the property of Akshar Creative until we have delivered the products to the address specified by you. If your payment is not received and you have already received the products you ordered from us, you must pay for or return those products to us in accordance with our reasonable return instructions and in the same condition that you received them at your own expense. If you do not do this within xx days of the date on which we cancel your order, we may collect or arrange for collection of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

DELIVERY TIME AND CHARGES

Delivery time and Charges

Delivery time vary depending on the type of products ordered. Delivery time is mentioned on the website against each item and is given as accurately as possible but cannot be guaranteed to be exact in nature due to circumstances beyond our control like bad weather natural disasters, political unrest, package missing from courier etc.

Akshar Creative does not ship outside India at this moment, and deliveries can be made at most of the locations in India as specified on the website. Certain items cannot be delivered to a few locations where our courier service is not available. Please ensure to check for the availability of delivery service for your shipping destination at the time of order completion on the website.

Please note that our gifts are dispatched from different ware houses spread across India. In the case where you have ordered more than one item, we might need to send your order in more than one package.

Once the order is dispatched to check where all your items are:

  3. Click ‘View order details’ next to the order you’re missing items from

Delivery attempts and cancellations:

Delivery will be to address specified in your order. Akshar Creative’s appointed courier  will deliver between 10 am and 6 pm on all working days (excluding National Holidays) in most of the locations as specified on the website. If no one is available at a residential or other address at the time of delivery, a note will be left to advise the arrival of the shipment followed by a text message or a telephone call.

In case of delivery to Institutes, hostel, hotels, hospitals and marriage or banquet halls, delivery will be made at the reception. We do not guarantee delivery to the direct recipient in such cases.

All risk in the products you order (including risk of loss and / or damage to the products) shall pass to you when they are handed over to the courier for delivering at the address specified in your order.

Where the supply of your product(s) or service(s) delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

In the event of non-delivery of items due to incomplete/wrong address or continuous unavailability of the person at the shipping address to receive the items from the courier, the order will be cancelled automatically and the two way courier service and handling charges will be deducted from your card payment, and the balance shall either be refunded or given as a Store Credit at the sole discretion of Akshar Creative. Akshar Creative shall not deliver to one of the family members on your behalf (in case of residential address) or shall not deliver to one of your colleagues (in case of factory or office establishment) in your absence unless the courier service provider does on his own at the latter’s risk. In the event of your refusal to receive the shipment from the courier willfully, then your order will be cancelled automatically and the two way courier service and handling charges will be deducted from your card payment. Remaining balance card payment collected from you if available shall be offered to you back in the form of Cart credit. In case of any non-obtain ability of courier service charges and handling charges due to non-delivery for the reasons a) delivery refusal b) continuous unavailability, Akshar Creative will send its claim to you for settling the payment within 15 days, failing which your future rights to buy from Akshar Creative will be banned for a limited period.

Replacement Policy

Akshar Creative offers easy replacement only in the case of damaged or incorrectly supplied goods. Akshar Creative reserves the right to offer you any one the three below mentioned options:

  1. Send a replacement product once the customer returns the damaged product/products
  2. Refund the amount only in the case where Akshar Creative cannot offer a replacement. The refund will be issued as store credit which will not include the handling charges and taxes

*Akshar Creative, in its sole discretion, will determine the usage of the given options.

What do I do if the product I received is damaged or incorrectly supplied on delivery?

You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery, you must note the details of any damage or error in supply on the delivery documentation or if you are unable to view the items on receipt, you must inform us (Customer Service Department by phone or email only) within 48 hrs of receipt of the items. You must return the products to us as soon as possible after informing us that the products are damaged or have been incorrectly supplied.

Applicability of Replacement Policy:

Akshar Creative will accept Replacement or Exchange only if the following conditions are met.

  1. Replacement request should be initiated within 48 hrs of order delivery.
  2. Customer should inform us that the products are damaged or have been incorrectly supplied within 48 hrs of order delivery.
  3. A photograph of the product along with the packaging should be emailed to hello@aksharcreative.in within 48 hrs of order delivery.
  4. The item needs to be returned along with the original packaging if requested by Akshar Creative. The package should be returned within 15 days from initiation.
  5. The tags on the product should be intact.
  6. The product should be unwashed, unused and in an undamaged condition

Please note the below conditions that apply to the replacement claim.

  1. Replacement for goods/ merchandise is subject to inspection and checking of returned product by Akshar Creative team.
  2. Replacement for goods/ merchandise will be initiated only once Akshar Creative receives the return package
  3. Damages due to neglect, improper usage or application will not be covered under our Replacement Policy.
  4. Some special rules for promotional offers may override “Akshar Creative 10 Days Replacement Policy.”
  5. In the case where the quality of any products, services, information, or other material purchased or obtained by you through the website did not meet your expectations, no compensation will be given other than the replacement of the product or store credit. Akshar Creative, in its sole discretion, will determine the usage of the given options.
  6. If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and for this reason, we recommend that you use an approved courier service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amount attributable to) such loss or damage.
  7. We receive returned goods only through approved courier service providers and you cannot return the goods in person physically to the Replacement Department.

What products, services and scenarios are not covered under the Replacement policy?

Applicability of the “Replacement Policy” do not apply to the below products, services and scenarios:

  • Custom made or personalized items
  • Any products with a seal where the seal is broken
  • Replacement request is made outside the specified time frame
  • Product is damaged because of use or Product is not in the same condition as you received it
  • Defective products which are covered under the manufacturer’s warranty
  • Anything missing from the package you’ve received including price tags, labels, original packing, freebies and accessories
  • Items which were sold as combos/sets, are not eligible for exchange/replacement as individual items

Do I get a reimbursement of courier charges for returns?

The courier charge will be refunded only in the case of damaged or incorrectly supplied items. To claim refund for the courier charges please follow the below steps:

Akshar Creative will notify you when we’ve received your return package. The courier charge will be refunded only once we receive the package and the same has gone successfully through our quality check.

Damage during the course of returning products: If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and for this reason, we recommend that you use an approved courier service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amount attributable to) such loss or damage.

Liability

Akshar Creative assumes no responsibility for the traded products relating to faulty or mis-described information that if otherwise results in any injury or death due to the negligence or errors in the workmanship of the product or your misuse. Akshar Creative offers only authentic, genuine and original products from the leading suppliers and brands; however, there is no guarantee to assure that these products will work fault free or that these products do satisfy your needs. As a trading partner, we hold no liabilities whatsoever arising out of the use or misuse of the products you have purchased from Akshar Creative.

Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, (incorrect or damaged) you can contact us for a Replacement. Please check our Replacement Policy for details. We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms by anything you (or anyone acting on your behalf) does or fails to do or due to events, which are beyond our reasonable control.

You must follow any advice we (or the manufacturer) give you to keep products, we supply to you, safe (including any instructions or product manuals provided with the products or website links on Akshar Creative or on the manufacturer’s website). We cannot accept liability for damage to products we have supplied, which is caused by your failure to follow this advice.

In any event, we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.
